$ 1 million EPA grant awards after the brownfieldu River the Community Conference in the Southeastern Michigan (MI)



"EPA is pleased with the sponsorship of the $ 1 million to supplement the Community Conference Revolving Fund loans," Hedman said. "On the basis of the excellent reputation of the DCC, I am convinced that this money will be put to good use in the Ostrava region along the River--from Monroe, Dearborn City Hall and Pumphouse Willow Run curtain # 2."


In the past five years, the EPA has granted the Community Conference $ 6.6 million loaned out to clean up contaminated sites and $ 1.65 million for brownfield assessment work. Since 1997, the EPA has granted 15 revolving loan fund grants to support individual and assessment grants totaling nearly $ 14 million.


The Community supports the Conference evaluation and cleanup of more than 210 seats. Conversion of these sites resulted in the creation or preservation of 1,000 jobs. Projects also generated more than $ 100 million in public and private investment, resulting in $ 2 million in tax revenues each year.

Companies in Illinois, Nebraska to Pay Settlements Totaling $84,387 for Distribution of Misbranded or Mislabeled Pesticides (NE)



(Lenexa, Kan., Aug. 19, 2013) - An Illinois pesticide manufacturer and a Nebraska company that sold some of its fly control products have agreed to pay civil penalties totaling $84,387 to EPA to settle allegations related to their roles in the distribution or sale of misbranded pesticides.


Wellmark International, Inc., of Schaumburg, Ill., has agreed to pay a $44,704 civil penalty to resolve 19 violations of the Federal Insecticide, Fungicide and Rodenticide Act (FIFRA) related to the Nebraska company’s distribution of its RF2025 Tub and RF2002 Block products from 2009 to 2011.Vitalix, Inc., of Alliance, Neb., has agreed to pay a $39,683 civil penalty to resolve 19 violations of FIFRA related to its sales of the RF2025 Tub misbranded as #5 Altosid IGR Fly Tub, and of the RF2002 Block product misbranded as Mineralix Fly Tub with Altosid IGR#11.EPA alleged that the two fly control products were either misbranded with labels that did not include required cautionary language, or were distributed in conjunction with claims that differed from the pesticide registration information filed with EPA.


Under FIFRA, distributors of pesticides must ensure that the information on their products’ labels contains the same required cautionary information as found on the labels filed with EPA by the pesticides’ registrants, and that those pesticides are not distributed with claims that differ from the registration information filed with EPA.


Under federal regulations, a pesticide’s supplemental distributor – in this case, Vitalix – and its registrant – in this case, Wellmark International – are both responsible for ensuring that the distributor’s product is in compliance with FIFRA and the terms of the product’s registration.


Through their respective settlements with EPA, Wellmark International and Vitalix have certified that they are now in compliance with FIFRA and its regulations.

EPA Extends Public Comment Period for Houston Superfund Site Proposal (TX)



In response to a community request during our August 6 public meeting, the U.S. Environmental Protection Agency (EPA) is extending the public comment period for the proposed cleanup plan amendment for the South Cavalcade Street Superfund Site in Houston, Texas. The comment period will now conclude on September 23, 2013.

The extension for public comment will allow the community more time to review the Agency’s proposal and provide valuable input to shape our proposed plan. EPA will conduct additional outreach with the community during this timeframe to share information and answer questions.


The proposed plan includes:


• Install additional monitoring wells and verify the boundaries of the contaminated ground water plume.


• Conduct long-term ground water monitoring to ensure early warning if the contaminated ground water plume get larger.


• Restrict access or use of ground water within the contaminated plume.


The South Cavalcade Street Superfund Site is a former wood treating site used from 1910 until 1962. The operations resulted in soils and ground water being contaminated with hydrocarbons, benzene, toluene, ethylbenzene, xylene, and metals (arsenic, chromium, copper, lead and zinc).


The EPA, in consultation with the Texas Commission on Environmental Quality, will select a final remedy for the site after considering all information submitted during the public comment period. The proposed action may be modified based on any new pertinent information received through public comments. EPA's plan will be documented in a Record of Decision (ROD) amendment and available for public review. A detailed response to public comments will also be included with the ROD amendment.


Ground water at the site is not used as a drinking water source; residents receive their water from City of Houston’s local lakes.

EPA Requires Bad River Band to Upgrade Wastewater Treatment Plant Operations



The U.S. Environmental Protection Agency today issued a compliance plan requiring the Bad River Band of Lake Superior and Chippewa Indians to correct Clean Water Act violations at the wastewater treatment facilities located on the Tribe’s northern Wisconsin reservation.

The Bad River Band must upgrade plant operations to correct the violations by January 31, 2014. Violations include failure to meet permit reporting requirements and failure to comply with permit effluent limits for phosphorus, E. coli, total suspended solids and biochemical oxygen demand. EPA will monitor the facilities to ensure that they meet compliance plan requirements and may take more formal action if violations are not corrected.

EPA Proposes to Renew Clean Harbors PCB Permit; Public Comment Period Begins (CA)



Today the U.S. Environmental Protection Agency is requesting comments on its proposed PCB permit renewal for Clean Harbors Los Angeles, LLC., a commercial hazardous waste treatment, storage, and transfer facility located approximately two miles south of Downtown Los Angeles in the industrial city of Vernon, Calif.

EPA’s proposed permit, if finalized, would be valid for 10 years and will allow Clean Harbors to continue to receive, store, and repackage PCB wastes. The draft permit imposes new additional safety requirements on the facility including regular random sampling, and more stringent cleanup standards if the facility were to close.


The 45-day comment period begins August 22 and ends October 7, 2013. The EPA is hosting an informational Public Meeting and Hearing on Tuesday, September 24, 2013 from 6 – 8pm at the Slauson Multipurpose Center located at 5306 S. Compton Ave, Los Angeles, CA 90011. Comments on the proposed renewal approval may be submitted over the phone; in writing via mail, email or fax; or in person at the public meeting and hearing. EPA will make a final decision on the renewal of the Clean Harbors PCB Approval after considering all public comments submitted.


The Clean Harbors facility has been in operation since 1980 and has been permitted to store PCBs since 1992.


Products that may contain PCBs include: electrical transformers and capacitors, other electrical equipment, and fluorescent light ballasts. EPA regulates the treatment, storage and disposal of PCBs under the Toxic Substances Control Act.

EPA Kicks Off Fourth-Annual Energy Star National Building Competition with More Than 3,000 Buildings (HQ)



Today, the U.S. Environmental Protection Agency (EPA) launched the 2013 Energy Star National Building Competition: Battle of the Buildings. Teams from more than 3,000 buildings across the country are competing to see who can most reduce their buildings’ energy use. In support of President Obama’s Climate Action Plan, which calls for buildings to cut waste and become at least 20 percent more energy efficient by 2020, the competition specifically targets wasted energy in commercial buildings and motivates businesses to improve energy efficiency, reduce harmful carbon pollution, and save money.

“Battle of the Buildings is a great opportunity for businesses to save money while reducing carbon pollution that contributes to climate change,” said EPA Administrator Gina McCarthy. “These are the kinds of smart, innovative solutions that are going to help solve the environmental challenges we face today.”


The number of participants in the Battle of the Buildings has increased from 14 buildings in 2010—the competition’s first year—to more than 3,200 buildings in 2013. Altogether, last year’s competitors cut their energy costs by more than $50 million and reduced annual greenhouse gas emissions equal to the electricity used by more than 43,000 homes.


More than 25 different types of commercial buildings are facing off in this year’s Energy Star National Building Competition, representing all 50 states, the District of Columbia, Puerto Rico, and the U.S. Virgin Islands. The diverse field of competitors includes the Hard Rock Hotel in Orlando, Fla., a Catholic cathedral and rectory in Seattle, New York City’s historic 100 Park Avenue building, and Busch Stadium—home of the St. Louis Cardinals.


Competitors measure and track their buildings’ monthly energy consumption using Portfolio Manager, EPA's Energy Star online energy measurement and tracking tool, and work over the year to cut energy waste through improvements that range from equipment replacement to changes in occupant behavior. Midpoint “weigh-in” results will be posted in December, with the winner announced in April 2014.


EPA features a list of the competitors and their weigh-in results on the Energy Star website, a live Twitter feed where competitors will post updates on their progress, an interactive map of the competitors’ locations, and a user-generated photo stream where competitors can upload pictures of their energy-saving efforts.


Commercial buildings in the U.S. are responsible for approximately 20 percent of both the nation’s energy use and greenhouse gas emissions at a cost of more than $100 billion annually. By improving the energy efficiency of the places Americans work, play, and learn, the competitors will save energy and reduce harmful carbon pollution that contributes to climate change.

The discussion will center on President Obama’s Climate Action Plan, released on June 25, 2013. It will also focus on strategies already being implemented to mitigate the effects of climate change and new approaches to reduce and better prepare for its impacts.

“2012 was the hottest year on record and there is no doubt that climate change is already here in the Hudson Valley,” said Judith A. Enck, EPA Regional Administrator. “Taking action to cut greenhouse gases and better withstand the impacts of climate change is critical to protecting the environment and people’s health. It’s also essential to our economy, with recovery from severe weather disasters costing billions of dollars each year.”


Climate change impacts range from more frequent and severe storms, floods, heat waves and wildfires to increased risk of asthma attacks and longer allergy seasons. In 2012 alone, the cost of weather disasters exceeded $110 billion in the United States, and climate change will only increase the frequency and intensity of these events.

Gina McCarthy, the EPA's Chief visits Alaska to highlight the climate action plan and tour Bristol Bay (AK)

Idaho sugar company failed to prevent industrial stormwater discharges, violated federal clean water rules (ID)



The Amalgamated Sugar Company, of Paul, Idaho, violated the Clean Water Act when it discharged stormwater without authorization under a federal industrial stormwater permit – the Multi Sector General Permit for Stormwater Discharges Associated with Industrial Activity – according to the U.S. Environmental Protection Agency.

“To help protect Idaho’s water quality, industries that discharge stormwater must follow the pollution controls required by the industrial stormwater permit,” said Ed Kowalski, director of EPA’s enforcement program in Seattle. “Companies who fail to comply with the industrial stormwater permit can put Idaho’s environment at risk and face federal penalties.”


The Amalgamated Sugar Company is an industrial facility and is required to apply for and comply with EPA’s Multi-Sector General Permit for Stormwater Discharges Associated with Industrial Activity. If the company had complied with the industrial stormwater permit, they would have been required to develop a stormwater pollution prevention plan and to conduct regular self-inspections of their stormwater controls.


In 2012, the company discharged 4,000 gallons of stormwater from its storage lagoon to a drainage and irrigation ditch that drains to the Snake River, without authorization under the industrial stormwater permit. To settle the violations, the company agreed to pay a $7,500 fine and comply with the permit’s stormwater controls and environmental protections.


The Multi Sector General Permit for Stormwater Discharges Associated with Industrial Activity is available to new applicants only until September 30, 2013. Because this permit is expiring, it is important for industrial stormwater dischargers that need permit coverage to seek it immediately.

Today's agreement resolves the alleged violation of key provisions of the law on the protection of the atmosphere at the refinery, including the requirements that are associated with the prevention of significant deterioration and new performance standards.


When it is fully implemented, the controls and requirements pursuant to this agreement will reduce emissions of sulphur dioxide (SO2) approximately 158 tonnes per year (tpy), nitrogen oxides (NOx), approximately 32 tonnes and particulate matter (PM) by approximately 36 tonnes per year. Further reduction in unstable and dangerous pollutants such as benzene, it is expected that as a result of compliance with the findings and repair requirements.


Sulphur dioxide and nitrogen oxides contribute to ground-level ozone, acid rain and the degradation of terrestrial and aquatic ecosystems and can also irritate the lungs and contribute to respiratory diseases. Fine particles pollution contains microscopic solid and liquid droplets which penetrate deep into the lungs and cause significant damage to the lungs and heart.


"This settlement will result in a substantial reduction of the air pollution of harmful and builds on previous settlements with area refineries, represents another step forward in improving the quality of air you breathe in the area of Utahns, Salt Lake City," said Robert g. Dreher, Assistant Attorney General for environment and natural resources division of the Ministry of Justice. "Big Western oil will be required to install advanced pollution control technology that will benefit the health and environment of their neighbors and future generations."


"EPA continues to provide significant settlements with refiners, who health and improve air quality in our communities," said Shaun McGrath, EPA's regional administrator in Denver. "Today's agreement will help bring a large oil refinery West of the current environmental protection standards."


Today's settlement requires a large Western oil to install state-of-the-art filter flue gas emission system PM and place ultra-low NOx gas burners and boilers, heaters, four. The company will also take measures to reduce SO2 emissions from the refinery, inter alia, restrictions on the hydrogen sulfide (H2S) in the fuel gas and the installation and operation of caustic scrubbers on sulfur recovery.


Moreover, big Western oil agreed to a number of improvements to its leak detection and repair program, including the installation of low-leaking valves and increase their waste to minimize or eliminate fugitive emissions of benzene. Cost of measures taken at the refinery is estimated at $ 18 million.


In addition, the company will spend $ 253,000 to supplemental environmental project laser detection system around the perimeter of hydrofluoric acid alkylation unit to improve recognition and response to release potentially dangerous acids. This system will reduce emissions and improve safety for workers, refinery and nearby communities.


The reduction of pollutants will benefit the communities in the vicinity of the refinery, which include significant minorities and low-income residents. The refinery is also located in areas designated as nonattainment for federal standard of 24 hours for fine particulate matter (PM2, 5).

Once the settlements are fully implemented, the company will reduce emissions of SO2, NOx and other pollutants by more than 360 000 tonnes per year. Settling the refiner invested or will invest more than $ 6.5 billion in new technologies for pollution control, and paid more than $ 93 million in criminal fines. Pueblo of Laguna Resident Receives National Community Involvement Award (NM)



The U.S. Environmental Protection Agency has recognized Amy Garcia of the Pueblo of Laguna as the winner of the national 2013 Citizen Excellence in Community Involvement Award. This annual award recognizes outstanding achievements in environmental protection and community-involvement leadership during Superfund cleanups. Superfund is the federal program created by Congress to address the country’s abandoned, uncontrolled hazardous waste sites.


“Superfund cleanups can be long and complex, and the process can take a toll on the surrounding area,” said EPA Regional Administrator Ron Curry. “Residents like Ms. Garcia who understand the community are indispensible in keeping residents informed and engaged during the process. Ms. Garcia’s dedication to the Pueblo of Laguna exemplifies the spirit of community leadership we seek to honor with this award.”


Ms. Garcia’s leadership has greatly helped EPA’s cleanup of the Grants Mining District, an area about 70 miles west of Albuquerque where contamination from former uranium mining is common. The affected area includes not only former mines but many private homes as well. In order to clean up these homes, EPA needed to obtain access agreements from residents.


Ms. Garcia was instrumental in helping EPA obtain access to start cleaning up the contamination on more than 500 residential properties in the Pueblo of Laguna villages. She ensured EPA and its contractors worked in a manner consistent with tribal customs, protocols and procedures. Her role as a liaison between EPA and the Pueblo greatly improved the success of EPA’s cleanup by keeping tribal members and homeowners informed during every step of the assessment and cleanup process.


Mathy Stanislaus, assistant administrator for EPA’s Office of Solid Waste and Emergency Response, presented the award to Ms. Garcia during the annual Tribal Lands and Environment Forum in Santa Ana Pueblo, New Mexico.

United States and the Commonwealth of Kentucky Reach Agreement with AK Steel Corporation to Resolve Clean Air Act Violations (SC)



The United States and the Commonwealth of Kentucky have reached a settlement with the AK Steel Corporation (AK Steel) in Ashland, Ky., resolving alleged violations of the Clean Air Act, AK Steel’s title V permit, and the Kentucky State Implementation Plan, announced the Department of Justice and the U.S. Environmental Protection Agency (EPA).


Under the terms of settlement, AK Steel will pay a civil penalty of $1.65 million, of which $25,000 will be paid to the Commonwealth of Kentucky, for the alleged violations that occurred at AK Steel’s former coke production facility in Ashland. AK Steel shut down the coke plant on June 21, 2011. Coke is used as a carbon source and as a fuel to heat and melt iron ore at steel making facilities.


Although AK Steel closed the plant involved in this enforcement action, AK Steel is currently operating the Ashland West Works facility a few miles away from the former coke plant. Under the agreement, AK Steel has agreed to spend at least $2 million on state projects to reduce particulate matter emissions at the Ashland West Works facility.


“This settlement holds AK Steel accountable for years of violations at its now closed coke plant in Ashland,” said Robert G. Dreher, Acting Assistant Attorney General for the Justice Department’s Environment and Natural Resources Division. “As a result of this agreement, state projects to reduce particulate matter emissions at the Ashland West Works facility will continue to improve air quality for area residents for many years to come.”


“This settlement promotes a healthier environment for our citizens and represents a just resolution of this matter,” said U.S. Attorney for the Eastern District of Kentucky Kerry B. Harvey. “We are committed to the effective enforcement of the environmental laws designed to protect the health of our people”


“We are proud to join with our partners in the Commonwealth of Kentucky in this step toward cleaner air and better health for the citizens of Ashland,” said Stan Meiburg, EPA Acting Regional Administrator in Atlanta.


The consent decree was lodged in the U.S. District Court for the Eastern District of Kentucky. Notice of the lodging of the consent decree will appear in the Federal Register allowing for a 30-day public comment period before the consent decree can be entered by the court as final judgment.
